Never Date a Leo

I thought cancers were compatible with leos.... hmmm. 2 of my ex's were leos.

Haven't blogged for a very, very, very long time. I was caught up with so many things at work. It's like my life has totally revolved around my work. But if it's any consolation... my i140 visa was approved yesterday. That means my immigrant petition was approved. But I have to extend my h1b visa until my priority date has become current. Not sure how long that would take. Maybe 3 years... who knows. At least this visa thingy is the least of my problems now.

J is coming for a visit this weekend. (Yea yea... him again. i can't seem to shake him off.... hehe.) I know it's gonna be another futile meeting. But oh well. A break from my mundane and monotonous boring life.

hello aisa! oonga, ang tagal mong mag-update ng blog. sa inaraw-araw na bisita ko dito, nakakainip makabasa ng bagong balita tungkol sa yo.

anyway, congrats on your approved I-140 petition. fyi, when you file for I-485 which is the adjustment of status, you can also file I-765 to apply for your Employment Authorization Document (EAD). this means you need not apply for a renewal of your H1B.

hello PE and dobs. can't file for i485 unless my priority date is current (jul02 priority as of today) kaya i need to file for the h1b extension. asar nga, i am stuck to this job until i can apply for i485. *hay nakuuuuuuu! hehe.

PE, magkano ba singil mo? :D

mak, i don't think that's correct. by having ur i-140 approved you have the right to file i-485. hindi nga lang mapa-process agad dahil they have a backlog which yun nga goes back to jul02 pa. kaya nga eligible ka na mag-file ng i-765 (ead) and get as many renewal as possible dahil sa backlog ng i-485.

i suggest you ask a real lawyer pero i think tama ako.

As per Form I-485 instructions, you may only file the form if there is a visa immediately/currently available to you. As of today, the current priority date for H1B is for a petition (I-140 in your case) filed on or before Aug 01, 2002.
For those with immediate relative family-based petition (I-130 for spouse, parents and unmarried children of a USC), an I-485 can be filed concurrently with the I-130 because there is no waiting period in that category. Of course you can file(improperly) your I-485 anytime you want to but there is a risk that it's going to be rejected. Your money won't be refunded in that case! Kahit naman, sa palagay natin, tatanggapin nila ang form nang maaga hindi pa rin ito mabibigyan ng pansin/adjudication hanggang hindi pa current ang visa. (E37 sa case mo, Mak!)
